CA 8 March 1994. Having been warned by the building society surveyor that there was risk of settlement on a house he wished to buy, M instructed the defendant to determine its stability. R reported favourably and M bought the house. Later another expert, G, foresaw further subsidence and recommended underpinning. M sought damages equal to the difference in value of the house in sound and unstable condition, but was granted £2 only on the grounds that though R was held negligent, no underpinning was required. M appealed and the judge concluded M was entitled to seek underpinning. Appeal allowed and £18,000 granted.
