In Channel Shipping v Newport Borough Council , QBD 28 January 1988, the court allowed the plaintiff`s appeal from a decision by Newport Justices, holding that the Justices had erred in overlooking the question of whether the occupants of the premises had the right to exclusive occupation for the purposes of deciding whether a rate demand was payable.
