In M R A Engineering Ltd v Trimster Co Ltd CA 20 October 1987 it was held that on the sale of land, rights of access granted to an existing tenant did not pass under Law of Property Act 1925 s62 after the surrender of the lease , if there was no express reservation in the conveyance.
