In McGrath v Shah ChD 13 October 1987 it was held that a purchaser of land could not escape the forfeiture of his deposit by the vendor on the purchaser`s failure to complete, by claiming that at the time the notice to complete was served, the purchaser was in the position to rescind the contract for misrepresentation and the notice was accordingly invalid.
