In "Tootal Clothing Ltd v Guinea Properties Management Ltd" CA 4 June 1992, it was held that Law of Property (Miscellaneous Provisions) Act 1989 s2 (superseding the Law of Property Act 1925 s40) has executory relevance. Once a contract has been completed, s2 of the 1989 Act is no longer relevant.
