Newberry and another v Turngiant Ltd CA 24 October 1991. After a delay in the completion of the sale of land both the vendors and the purchasers claimed interest on the balance of the purchase price outstanding during the delay. The vendors were found not to be in default although the delay was due to registrations at the Land Registry against the vendors. The purchasers` appeal for the sum of interest to be deducted from the purchase price was dismissed because of the inconsistency between the purchase contract and the Law Society`s General Conditions of Sale incorporated in the contract.
