In Charles Follett Ltd v Cabtell Investment Co Ltd ,ChD 1986, it was demonstrated that where a tenant is successful in an application for the grant of a new lease under Landlord and Tenant Act 1954 Part II ,the court may have to determine the duration of the new tenancy , the rent and other terms in the absence of any agreement between the parties.
