This article discusses a case which came to court concerning the display of an advertisement. Gloucestershire CC issued a summons alleging the company Mills and Allen Ltd, contrary to Town and Country Planning Act 1971 s109(2), displayed an advertisement which contravened the Town and Country Planning (Control of Advertisements) Regulations 1984. The author begins by looking at the provisions of the Act and Regs 11 and 16 with which the case was concerned. He then goes on to outline the main points of the case and the reasoning behind the judgement given.
