ChD 5 July 1989. Sale of a site to be developed as a supermarket. The plaintiff Colin Buckle (CB) claimed breach of an oral agreement between himself and Charterhall Properties Ltd CP . The agreement was for 1% of the purchase price and 15 of the sale price. The former was paid but CP contested that the latter had been agreed. CB took notes at the meeting at which the agreement had been made. CB also sent letters to CP confirming the agreement but, CP did not reply. CP refused to pay the fee and CB issued a writ. At the trial the evidence presented by CB and his conduct as a witness was considered reliable, CP`s witness was not. This together with the notes and letters established that there had been an oral contract. CB was awarded damages of the 1% fee plus the interest he would have received from the date he would have expected commission .
