In a discussion of set-off and counterclaims for defective work the author considers Lord Denning`s obiter dicta in "Dawnays Ltd v F.G. Minter Ltd" (1971) and its overruling in the HL "Modern Engineering (Bristol) Ltd v Gilbert-Ash (Northern) Ltd" (1974), which held that it was untenable that rights of set-off or counterclaim could not be raised against interim certificates.
