As a result of the decisions in recent cases Sharneyford Supplies Ltd v Edge and Ray v Druce , this article discusses whether the days of the rule in Bain v Fothergill are coming to an end. Looks at the problem of limiting the rule, and its possible abolition, especially since the Law Commission working paper which recommended that it be abolished.
