"Clarke v Smith" CA 4 July 1995. CC`s decision upheld on the grounds that on oral evidence and an expert`s report the foundations of an extension were too shallow and therefore the defendant was in breach of contract for poor standard of workmanship and for failing to fulfil duty of care obligations.
