"Calder v SoS Environment and others" QBD 9 March 1995. An application for diversion of a bridleway crossing proposed dwelling plots. Planning permission was quashed by HC. SoS Environment refused Tarmac`s request to divert the bridleway under Town and Country Planning Act 1990 s247. T`s application to continue work on the 3 plots was refused. T appealed to SoS who proposed to make a diversion order. Application to quash the order dismissed.
