In Hobday and another v SOS for the Environment and another CA 29 March 1990 it was held that an inspector in considering an appeal against an enforcement notice alleging material change of use , failed to show why it was not possible or desirable to impose a condition which would ensure that the " parking " objections to the development could be controlled.
