With reference to recent case law, Fowell v National Coal Board (1986) (See WB2249-14) and Percival v Walsall Metropolitan Borough Council (1986) (See Abstract 36601), this article examines the complex legal situation regarding limitation brought about by the Limitation Act 1980 and further exacerbated by the Latent Damage Act 1986 . Claims that the building industry faces even more problems concerning liability for negligence when the Consumer Protection Bill becomes law.
