In "Linden Gardens Trust v Lenesta Sludge Disposals Ltd and others" "St Martins Property Corporation Ltd and another v Sir Robert McAlpine and Sons Ltd" HL 22 July 1993 upheld the CA decision (See WB2805-05) on the grounds that JCT 1980 Cl 17(1) prohibits assignment. Appeals dismissed.
