Scottish Land Court 8 November 1989. The landlords of four vacant holdings applied to the Land Court for an order declaring that the holdings were not within the meaning of Crofters (Scotland) Act 1955 . The four holdings had been registered with the Crofter`s Commission in 1956 but had fallen vacant since. It was held that if the landlord discharged the onus upon him of proving that a holding lacked the necessary legal qualifications for being a croft the fact of its entry in the Register of Crofts would not in itself confer the necessary status therefore it was found that the holdings were not crofts.
