Application for judicial review to quash SoS Transport`s refusal to purchase the appellants` property under powers contained in Highways Act 1980 s246(2A) and failing to declare that the appellants property was seriously affected by construction of the Cirencester Bypass. Alleged that DTp guidelines for interpreting powers had been misapplied. Decision to be quashed but declaration refused.
