Interest in land is a matter of fact - 1989 - Times 15/5/89 p28 .

In R v SoS for the Environment and another ex parte Davies , QBD 11 May 1989, it was held that whether a person wishing to appeal against an enforcement notice had an `interest in the land to which the notice relates` might be a question of fact; and if it was, a refusal by the SoS to entertain such an appeal, on the ground of lack of such an interest, would only be susceptible of judicial review if it was shown to have been perverse.
