Refusal of consent to alternatives - 1989 - EGCS 1989 68 .

In Davies v Yadegar , CA 3 May 1989, it was held that the recorder had been correct to hold that the lessor had unreasonably refused consent. The respondent was entitled to carry out alterations . The air space over the roof was part of the demise and had not been reserved or excepted to lessor.
