In R v SoS for the Environment and another ex parte Kent , CA 5 May 1989, it was held that the court had no jurisdiction to entertain an application for judicial review of a decision of the SoS to allow an appeal against refusal of planning permission even where the local authority had failed to notify persons affected by proposed development of the planning application.
