Macdonald v Prentice`s Testamentary Trust and Others - 1993 - SLC 1993 R 97-125(29) .

SLC Application Lochaber RN 243 - Order of 28 July 1993. The Applicant applied to the Court for a declarator that certain areas of hill grazing formed a common grazing in which she and other crofters had a right to graze and cut peat. The Applicant contended that the area in question constituted a common grazings whilst one of the landlords maintained that the crofters had individual rights of grazing which were pertinents of their crofts. Certain other landlords contended that the crofters` rights amounted only to separate personal licences. The Court, in their decision, considered in detail the difference between a crofter`s right in a common grazing and a crofter;s right of grazing forming a pertinent of his croft. The Court held that the area of ground in question was not a common grazing within the meaning of the Crofters Acts but that the Applicant and the other crofters had individual rights of grazing and cutting peat on the subjects which were deemed to form part of their re
