In "Cochrane v Williams" CA 13 July 1993, a dispute over a brick wall built to replace a fence along a common boundary, CA overturned the CC decision that consequential use of wider access with construction of metal gates by defendant had been by the plaintiff`s leave and licence. CC`s order discharged. Retrial ordered.
