Hughes and another v Doncaster MBC CA 10 November 1989. It was held that the respondents` claim for disturbance was not invalidated by compensation under Land Compensation Act 1971 s5 rule 4 for the value of the land but that development immune from enforcement under the Town and Country Planning Act 1971 was "contrary to law" for rule (4).
