In G P and P Ltd v Bulcraig and Davis and Another CA 27 October 1987 it was held that in quantifying damages , the correct method of valuing beneficial occupation for the set off against the final award was to take the rental value of the refurbished premises and deduct from it the rent actually paid under the lease .
