ORC 15 May 1990. J applied for a 0.14 summary judgement (0.29 interim payment for unpaid architect`s interim certificate . The C applied for a stay of proceedings under the Arbitration Act 1950 s4 . Matters raised were what was suitable for Order 14 hearing, inappropriate cases to be discouraged where there is an arbitration clause. It was held that the summary shall be dismissed and referred to an arbitrator.
