"Robert Leonard Developments Ltd v Selby-Kaye" CA 18 March 1993. An appeal by a tenant who agreed to surrender a lease due to financial difficulties and whose landlords had tried to obtain a premium from the new tenants, in lieu of balance of rent. The plaintiff claimed the landlord was in breach of an implied term to use best endeavours to obtain a premium on reletting the premises. Appeal dismissed.
