CA 26 June 1990. Appeal against HC decision (Abs 42619) by Z against damages awarded to B. Concerned with same form of contract as in Rosehaugh Stanhope (Broadgate Phase 6) plc v Redpath Dorman Long Ltd (Abs). It was held that Z was not to be treated in breach of contract and would have completed with a reasonable extension of time. Appeal allowed.
