Etheridge and another v SoS for the Environment and another QBD 8 March 1991. An inspector allowing private development on land which would be required for public development proposals was found to be wanting in his interpretation of DCPN 5 , which provides that private development is normally not allowed, where it conflicts with public proposals already in the development plan or in some cases even where it is not.
