Uttlesford DC v SoS for the Environment and another QBD 4 March 1991. It was decided that using part of a garage as an extension of the living area did not constitute the creation of a separate planning unit since the test of single family occupation of the annex failed. The council`s claim that this use was a breach of planning control was dismissed.
