Brook (VO) v Greggs plc and other LT 25 February 1991. It was held that for rating purposes the market stallholders did have exclusive occupation in spite of controls by the council. However, the VO`s proposal to list each stall individually on the valuation list was spoilt by the the fact that four hereditaments could not be identified and it was not within the jurisdiction of the court to decide how the list could be amended without including all hereditaments.
