CA 6 January 1995. Where an action for the forfeiture of a lease was dismissed the lease was restored to its full existence. Therefore the tenant (H) was eligible under the Leasehold Reform Act 1967 Part 1, to apply to acquire the freehold of the property. The appeal by the landlord (T) was dismissed.
