The decisions of Murphy v Brentwood DC and DoE v Thomas E. Bates and Sons Ltd , restrict the liability of the local authority or contractor for defective buildings. Recovery in negligence now relies on there being physical damage to persons or property. Anns v Merton LBC , Dutton v Bognor Regis UDC and all cases following them are overruled.
