Discusses why the House of Lords departed from the decision of Anns v Merton LBC 1978 AC 728 in their judgement of Murphy v Brentwood DC HL 26 July 1990. The council was found not liable for the cost of remedial work required to correct defects caused by a defective concrete raft , which, although approved by the council on the advice of consulting engineers, was incorrectly designed.
