CA 9 May 1990. At issue was the procedure of granting injunctions under Local Government Act 1972 s222(1) and County Courts Act 1984 s22 with respect to the breach of a tree preservation order . Although the courts were correct in granting an injunction under these acts, the appeal was allowed since it was unlikely that the appellant would commit further breaches of the order and an injunction in support of criminal law was unnecessary.
