ChD 10 January 1990. The plaintiffs sought an injunction to stop the defendants from building a block of flats , which would obstruct their right to light . It was thought, however, by the judge that an injunction was unlikely to be granted and the plaintiffs rejected an offer of an interim injunction provided they paid costs if it was found to have been wrongly granted. Claims by plaintiffs struck out.
