CA 6 February 1990. Upheld the earlier decision to allow the landlord`s (R) possession order but rethought the question of the tenant`s (C) counterclaim in the face of demands for arrears of rent , for overpaid rent, since it was discovered that there was a registered rent for the flat unfurnished, which was substantially less than the rent C was paying for the flat furnished. C won her counterclaim, which cancelled R`s claim for arrears of rent.
