In R v East Hertfordshire DC , ex parte Smith CA 3 April 1990 it was held that an offer of temporary accommodation with no promise of permanent accommodation to follow, could satisfy the the duty of a council under Land Compensation Act 1973 s39 to rehouse people displaced by a compulsory purchase order.
