"Barclays Bank plc v MEPC Developments Ltd" CA 9 March 1995. An agreement for a proposed retail development made between landowner and developer created an option in favour of B to sell its land to M, by serving a sale notice obliging M to purchase the land subject to planning permission and any further land. Planning permission was refused and B served the sale notice. The definition of further land was disputed. B`s appeal allowed.
