In R v Brooker and Others , ex parte Hitchin Town Football and Social Club Ltd and Others QBD 3 April 1990 it was held that the Commonable Rights Compensation Act 1882 was not part of the statutory code found in the Inclosure Acts 1845 to 1859 and so it was not necessary to look at the Inclosure Act 1845 s16 to define "persons interested in land".
