In Pollway Nominees Ltd v Havering LBC , QBD 28 April 1989, it was held that although the part of the building which covered the rising damp did not belong to their company it was the state of the flat that was prejudicial to health, therefore although the owner could not remedy the defect it did not prevent him being the person on which the notice was served.
