In "Ruxley Electronics and Construction Ltd v Forsyth, Laddington Enclosures Ltd v Same" CA 16 December 1993, it was held that it was not unreasonable where a swimming pool had been constructed to a depth less than that contracted for, to award as damages the costs of the rebuilding necessary to make good the breach of contract even though the shortfall in the depth had not decreased the value of the pool. Appeal by defendant allowed.
