In "Wychavon DC v SoS for Environment and another" QBD 16 December 1993, an application to quash a decision by a planning inspector allowing an appeal against the refusal by W to allow planning permission for the erection of poultry houses and agricultural dwellings, was turned down on the grounds that a district council was not an individual under Community law and could not rely on the provisions of an EC Directive unimplemented by UK legislation as against a private individual. fi
