In "Christchurch BC v SoS Environment" CA 16 December 1993, overturned High Court decision (see WB2814-44) in allowing appeal by C. The planning inspector failed to correctly assess the use of the land by not distinguishing between potential use as public open space and the existing situation where the land was open space and informal recreational use tolerated.
