"Faragher v Gerber" QBD 27 June 1994. The defendant solicitor is guilty of negligence in failing to carry out a full search before advising client of flat purchase. Plaintiff had to vacate flat whilst road works were carried out. Damages assessed as the difference between price paid and the market value which the property possessed with highway development. Any compensation obtained as a result of a Land Compensation Act 1973 claim was not deductible from damages awarded.
