In Welsh Aggregates Ltd v Clwyd County Council CA 14 June 1988 it was held that quarrying which caused the destruction or obstruction of a public footpath which was a highway and had not been stopped or diverted was unlawful, even though the person carrying out the quarrying did not know and had no reason to know of the existence of the highway.
