CA 24 April 1990. Appeal by defendant (W) against CC decision in granting possession order to landlord (K). Concerned a landlord`s claim for possession and whether tenant in occupation was a business tenant within the landlord and Tenant Act 1954 Part II as landlord contested or a residential tenant entitled to protection of Rent Act 1977 . Conflict of evidence regarding use of premises. CA upheld the CC decision, that it was a business tenancy and K had complied with the terms of the 1954 Act in giving proper notice to W. Appeal dismissed.
