In "re Land at Freshfields", ChD 27 January 1993, it was held that the meaning of the word `garden` in the context of Common Land (Rectification of Registers) Act 1989 s1(3) did not extend to pasture land and accordingly since the requirements of s1(2) of the 1989 Act had not been satisfied, the court had no power to order its removal from the register maintained under the Commons Registration Act 1965.
