CA 5 July 1994. In 1991 F entered into 3 agreements with F for the occupation of two service stations: (1) A partnership licence agreement for 3 years giving permission to F to use E`s land, fixtures and fittings and containing obligations by F for the control and management of the service stations by E. (2) A shop franchise agreement requiring F to operate an Esso shop in accordance with the provisions of a manual. (3) A car wash agreement containing provisions for the operation of the car wash. F failed to make payments to E and the agreements were terminated in September 1993. F appealed the order giving possession of the service stations to E under RSC Ord 113. Appeal dismissed.
