In "Tesco Stores Ltd and another v SoS Environment and another" QBD 7 July 1993, SoS`s decision was quashed on the grounds that he had failed to take the local plan inspector`s preference into consideration, particularly the superstore`s offer to fund the road network by applying the test in Annex B paras B8 and B9 of Circular 16/91 incorrectly.
